Information on Digital Services and the Right of Withdrawal

Nature of the Service

Talent.pl is a platform that enables real-time HD image generation and provides features related to digital content and its licensing. Image generation constitutes a digital service performed immediately upon the user’s request, for example, after entering a prompt and initiating generation.

Pricing Model

The Start plan costs PLN 38 per month and includes a limit of 100 HD images, the Creator plan costs PLN 98 per month and includes a limit of 250 HD images, and the Agency plan costs PLN 699 per month and includes a limit of 1500 HD images.

When Service Provision Begins

In the case of AI-generated content, service provision begins immediately following the user’s action and is performed without delay.[cite:99] The Terms and Conditions provide that the scope and nature of such service provision, including its implications for the right of withdrawal, should be clearly communicated to the user before placing an order or initiating generation.

Right of Withdrawal

Consumers and entrepreneurs entitled to consumer protection may, as a general rule, withdraw from a distance contract within 14 days, subject to exceptions provided by law. With regard to digital content not supplied on a tangible medium, including AI content generated immediately upon request, the right of withdrawal may be lost once performance begins if the user has expressly consented to this and has been informed in advance of the consequences of such consent.

When the Right of Withdrawal May Not Apply

If the user requests that provision of the digital service begin before the withdrawal period expires and accepts the loss of this right once the service has been fully performed, withdrawal may not be possible in relation to the particular generation. This applies in particular when an image has already been generated in accordance with the user’s request.

Grounds for Filing a Complaint

The Terms and Conditions indicate that examples of defects in a digital service may include prolonged unannounced unavailability of the platform, a permanent inability to download purchased content, or significant functional differences compared with the offer description. Dissatisfaction with the aesthetic outcome of a generated image alone is not considered a defect in the service if the platform functioned correctly from a technical standpoint.

How to Submit a Complaint or Withdrawal Notice

A complaint may be submitted electronically or in writing to the Service Provider’s address. A contract withdrawal form may be provided as a separate document or as part of the purchasing process, and the Terms and Conditions also include a template for such a form.

2. Send the form electronically to the email address provided above or by post to the Service Provider’s address.
3. The form may only be used if the right of withdrawal has not been excluded or lost under applicable law and the terms governing the provision of the digital service.
4. In the case of digital content generated immediately upon request, the right of withdrawal may not apply if the user has consented to the commencement of performance before the withdrawal period expires and has been informed of the loss of this right.

If the user requests that service provision begin before the 14-day period expires and is informed of the loss of the right of withdrawal upon full performance of the service, withdrawal may not be possible in relation to a generation already completed or another fully performed digital service.
