02 — Expert

Who I am

Attorney-at-law, Doctor of Laws, creator of the Talent.pl platform.
I combine a legal practice in new technologies law with direct experience as an AI platform operator.

Attorney-at-law Dr Wiktor Czeszejko-Sochacki, registered with the Warsaw Regional Chamber of Legal Advisers. A graduate of the Faculty of Law and Administration and the Centre for French Law at the University of Warsaw.

He obtained an LL.M. in French, European and international commercial law at Université Paris II Panthéon–Assas, where he subsequently defended his doctorate in law. He is fluent in English and French, which allows him to work directly with EU regulations in their original language versions and to serve foreign clients and cross-border transactions.

He is the creator of the Talent.pl platform project and of the planned Legaldesk.online service — the first service in Poland to combine AI image generation with a legal architecture of commercial licences compliant with the Artificial Intelligence Act and the GDPR. This practical grounding in the world of digital platforms sets him apart from lawyers who deal only with the theory of regulation.

03 — Scope of services

Four areas of specialisation

Advice focused on issues specific to creators, creative agencies and entities developing their own technology solutions.

2.1

Licensing of AI-generated content

Content generated by artificial intelligence systems is not automatically covered by traditional copyright protection. It is necessary to define precisely who is entitled to use the generated image, on what terms and to what extent.

Drafting licence agreements and terms of service for platforms that generate images, video or text using AI

Designing multi-tier licence models (e.g. Model S / Model R / Special Model) tailored to different user groups

Analysis of the scope of copyright in AI-generated works — under Polish and EU law

Reviewing agreements with AI model providers (Stability AI, OpenAI, Midjourney and others) for commercial restrictions

Drafting clauses on prohibited content, user liability and licence limits

Advice on implementing NFT licences and the tokenisation of rights to digital content

2.2

Compliance with the Artificial Intelligence Act and the GDPR

Content generated by artificial intelligence systems is not automatically covered by traditional copyright protection. It is necessary to define precisely who is entitled to use the generated image, on what terms and to what extent.

Failure to meet the obligations under the Artificial Intelligence Act (AI Act) carries fines of up to EUR 15 million or 3% of total worldwide annual turnover — and for the most serious infringements (prohibited systems, Art. 5) up to EUR 35 million or 7% of turnover (Art. 99 of the Act).

Classification of an AI system by risk level (minimal / limited / high / unacceptable) in accordance with the Artificial Intelligence Act (AI Act)

Preparation of the technical and legal documentation required for high-risk AI systems

Implementation of information and transparency obligations for systems generating synthetic content (deepfakes, AIGC)

GDPR audit of the platform — records of processing activities, legal bases, retention policies

Preparation of data protection impact assessments (DPIA) for AI systems processing sensitive data

Advice on implementing NIS2 and DORA requirements for digital platforms

Representation before supervisory authorities — UODO, UOKiK, CERT

2.3

Intellectual property protection in the context of AI

Copyright infringement in the field of AI is widespread and growing. Generative models trained on protected data, images deceptively similar to the works of human artists, unauthorised use of a person’s image — these are real risks that require proactive protection and effective action in the event of an infringement.

Analysis of the risk of copyright infringement by AI systems trained on other people’s works

Protective measures — trademark registration, legal notices, provenance labelling

Pursuing claims for infringement of copyright in generated content or in an artistic style

Preparation of DMCA/EUCD policies for user-generated content platforms (notice & takedown procedures)

Advice on the protection of image and personal rights in the context of generative AI

Protecting rights to AI models and training data — trade secrets, NDAs

2.4

Legal services for digital platforms and SaaS

Running an online platform involves a number of legal obligations arising from the DSA, the Consumer Rights Act, tax regulations and sector-specific rules. Comprehensive legal services help avoid costly mistakes at the design stage, instead of fixing them after the fact.

Drafting or reviewing the terms of service — compliance with the Consumer Rights Act, the GDPR and the DSA

Privacy policy and cookie policy — meeting the requirements of the GDPR and the Telecommunications Law

Model withdrawal forms and return policies compliant with Art. 27–38 of the Consumer Rights Act

Implementation of the DSA (Digital Services Act) — content moderation, transparency, targeted advertising

DMA (Digital Markets Act) compliance for gatekeeper platforms

Legal architecture of the subscription model — terms of renewal, cancellation and refunds

Advice on e-invoicing and digital settlements (KSeF, VAT on electronically supplied services)

Preparation of B2B agreements with API, hosting and cloud infrastructure providers
