Why do we label AI-generated content?

Talent.pl uses generative artificial intelligence models to create images. We want it to be clear at all times which content has been created with the help of AI — for your audience, customers and business partners, and in accordance with the requirements of the European AI Act.

How the signage works — two levels

Digital metadata (IPTC/XMP)Label on the platform
Where is it located?Within the image file itself (invisible data layer)On the talent.pl interface — next to the image, in the panel and when downloading
VisibilityInvisible to the naked eye — read by software (e.g. Adobe, stock image libraries)Visible to every viewer of the image on the platform
Impact on the fileNone — a file that is visually identical, with no loss of qualityBrak — etykieta nie jest częścią pliku
When is it added?Automatically, with every generation, without exceptionAutomatically, wherever the image is displayed on the platform

We do not place a logo or watermark embedded within the pixels of the image — your files retain their full utility for use in portfolios, printing, publication or resale under licence, without any interference with their appearance. Compliance with regulations is ensured by digital metadata and a label visible on the platform.

Legal basis

  • Article 50(2) of Regulation (EU) 2024/1689 (the AI Act) requires that AI-generated content be labelled in a machine-readable format and be identifiable as having been generated by an AI.
  • Article 50(4) of the AI Act provides that, for content forming part of an artistic, creative or fictional work, the disclosure obligation is limited to a form that does not impede the display or use of the work — this is achieved by a label visible on the platform.

AI Passport

Every image generated within the Agency plan is assigned a digital AI passport – a unique identifier recorded in the Talent.pl register, together with metadata on its origin (model, guarantee date, subscription plan). The passport confirms the origin and the time at which the image was generated.

The legal status of AI-generated content

AI Content may not be subject to copyright protection within the meaning of the provisions applicable to works created by humans. However, the use of AI Content under a licence granted by talent.pl is legally valid and entitles the user to use it in accordance with the Terms and Conditions and the selected plan.

Your responsibilities as a user

  • You must not enter any prompts into the system that infringe the law, personal rights, trade secrets or other rights of third parties.
  • You are responsible for assessing whether your use of AI Content complies with the regulations applicable to your sector, business or target market.
  • Do not remove origin markings from the AI if they are required.

Talent.pl does not guarantee that all AI-generated content will be 100% free from similarities to existing works, trademarks or solutions protected by law — it is therefore advisable to assess the acceptability of the intended use in your specific business context on a case-by-case basis. talent.pl reserves the right to apply content filters and block accounts that flagrantly and persistently breach the rules for using AI.
