3. Characteristics of the AI systems used on the Talent.pl website

3.1. Generative AI system for creating images

3.1.1. Description and purpose of the system

The Talent.pl website provides users with a feature for generating digital images using a generative artificial intelligence system. The user provides input in the form of a text description (prompt) – in Polish or English – and the AI system processes this description and generates a digital image corresponding to the content of the prompt. This feature is available as part of selected subscription plans of the Talent.pl website.

The system enables: – generating unique digital images based on text descriptions, – modifying existing images using text commands (img-to-img or inpainting feature, if available), – generating images in artistic styles specified by the user, – creating images in various formats and resolutions.

3.1.2. System type and classification

System type: a generative AI system within the meaning of Art. 3 point 63 in conjunction with Art. 3 point 66 of the AI Act, based on a generative model with a diffusion architecture (diffusion model) or another comparable generative architecture.

Risk classification: The system is classified as a limited-risk AI system within the meaning of Chapter IV of the AI Act (Art. 50). The system is not included in the list of high-risk AI systems (Annex III to the AI Act) and does not meet the criteria for qualification in that category. It is not used in any of the high-risk areas listed in Art. 6 of the AI Act, such as critical infrastructure, education, employment, public services, law enforcement, the administration of justice or migration management.

Due to the classification of the system as a limited-risk system, the Talent.pl website is subject primarily to the transparency obligations under Art. 50 of the AI Act, described in detail in Chapter 4 of this document.

3.1.3. AI models used

The Talent.pl website uses AI models supplied by external providers of general-purpose AI (GPAI) models or models fine-tuned on the basis of publicly available foundation models. Detailed identification of the models, their technical architecture and data concerning the training process are protected as trade secrets in accordance with Art. 13(3) of the AI Act and are not subject to disclosure in this document.

The website Administrator keeps the technical documentation of the AI models at the disposal of supervisory authorities in accordance with the requirements of the AI Act.

3.1.4. System capabilities

The generative AI system used on the Talent.pl website is capable of:

  • generating highly detailed digital images based on text descriptions,
  • understanding complex, multi-element text descriptions,
  • reproducing a variety of artistic styles (painting, photorealism, illustration, digital graphics and others),
  • generating content across a broad thematic spectrum, excluding content covered by the prohibitions described in Chapter 5,
  • processing prompts in multiple languages.

3.1.5. System limitations

Users should be aware of the following system limitations:

  • No guarantee of accuracy – the system may generate images containing elements inconsistent with the description or deviating from the user’s expectations; the quality of the results depends on the precision and level of detail of the prompt provided.
  • Risk of reproducing patterns from training data – the system, like all generative AI systems, may generate content reflecting patterns contained in the training data, including potentially outdated or biased depictions.
  • Inability to identify real persons – the system should not generate credible likenesses of specific, identifiable natural persons; however, due to the nature of the generation process, it is not possible to guarantee the complete elimination of accidental resemblances.
  • No fact-checking capability – the system generates visual content and is not capable of verifying whether the generated images correspond to reality.
  • Non-determinism – repeated use of the same prompt may lead to different results.
  • Limitations of cultural context – the system may show limited sensitivity to specific cultural or local contexts.

3.2. Content recommendation system

To the extent that the Talent.pl website uses content recommendation systems or systems for personalising the materials presented, such a system operates in accordance with:

  • Art. 27 DSA – governing the obligations of online platforms with regard to the transparency of recommender systems,
  • Art. 22 GDPR – governing automated decision-making, including profiling.

Users are informed about the use of recommender systems in a separate document available in the Privacy Policy and the Terms of Service of the website. Users have the right to use alternative forms of content presentation not based on profiling, if such an option is available.

4. Obligation to label AI-generated content

4.1. Basis of the obligation

Pursuant to Art. 50(2) of the AI Act, the Talent.pl website, as a deployer of a generative AI system, is obliged to ensure that the outputs of the AI system (generated images) are marked in a machine-readable format and are detectable as artificially generated or manipulated.

Pursuant to Art. 50(4) of the AI Act, to the extent that generated content may constitute a deepfake within the meaning of the legal definition, the deployer is obliged to disclose that the content has been artificially generated or manipulated.

4.2. Multi-layered AI content marking system

The Talent.pl website applies a multi-layered approach to marking AI-generated content, ensuring the effectiveness, robustness and interoperability of the marking:

4.2.1. Layer 1 – Technical metadata (C2PA/IPTC)

Every image generated by the AI system on the Talent.pl website is marked by means of:

  • C2PA metadata (Coalition for Content Provenance and Authenticity) – a cryptographically signed C2PA manifest containing information on: (a) the fact that the content was generated by an AI system, (b) the date and time of generation, (c) the identifier of the AI system (without disclosing technical details protected as trade secrets), (d) the unaltered content provenance chain. The C2PA manifest is embedded in the image file in a format invisible to the average user but readable by automated detection systems, in accordance with the C2PA 2.x specification.
  • IPTC metadata – IPTC metadata fields embedded in the image file (XMP/EXIF format) containing, in particular: the label “AI-generated” or an equivalent in accordance with the adopted terminology scheme, the identifier of the Talent.pl website as the deployer, and information on the date the content was generated.

4.2.2. Layer 2 – Digital watermark

To the extent technically feasible, the Talent.pl website uses invisible digital watermarks embedded directly in the pixel data of the generated image. The digital watermark:

  • is resistant to typical file transformations (compression, resizing, format conversion),
  • contains a unique content identifier enabling it to be linked to system records,
  • can be verified using specialised detection tools.

The use of digital watermarks takes into account the current state of the art and is proportionate to the technical capabilities of the system.

4.2.3. Layer 3 – Visual label in the website interface

Irrespective of the technical marking, all AI-generated content on the Talent.pl website is clearly labelled visually in the user interface by means of:

  • a visible text label “Generated by AI” or “AI Generated” placed within or directly next to the displayed image,
  • an icon or graphic symbol clearly indicating the artificial origin of the content,
  • information in the description/metadata of the profile or gallery stating that the content was generated by AI.

The visual label is clearly visible and legible and cannot be hidden or removed by the user to the extent that the content is presented to other users on the website.

4.3. Information obligation before content is generated

In accordance with Art. 50(5) of the AI Act, information about the use of the AI system is provided to the user in a clear and distinguishable manner before the first use of the generation feature or, at the latest, at the time the first prompt is submitted. This information covers:

  • the fact that the output is AI-generated content,
  • the way in which the generated content is marked,
  • the limitations of the AI system described in Chapter 3.1.5.

4.4. Prohibition on removing or modifying the marking

Users of the Talent.pl website are not entitled to remove, hide or modify the AI content marking described in this chapter. Doing so constitutes a breach of the Terms of Service of the website and may result in legal liability under the applicable provisions.

4.5. Content co-created by humans and AI

In the case of content that was generated by AI and subsequently significantly modified by the user (a human), the Talent.pl website applies the label “AI-assisted” or “Co-created with AI”, indicating the partial involvement of the AI system in the creation of the content. The scope of modifications qualifying as “significant” is defined in the Terms of Service of the website.

5. Prohibition on creating unlawful content – deepfakes and other prohibited content

5.1. Definition and risks of deepfakes

A deepfake within the meaning of Art. 3 point 60 of the AI Act is a special category of AI-generated content associated with an increased risk of infringement of the rights of natural persons, disinformation and manipulation. The Talent.pl website treats the prevention of the creation of unlawful deepfakes as a compliance priority.

5.2. Categories of prohibited content

  1. realistically depicts identifiable natural persons without their explicit consent, in particular in a context that could violate their dignity, good name or personal rights,
  2. constitutes pornography or sexual content depicting, or capable of being mistaken for the likeness of, specific persons without their consent (so-called non-consensual intimate imagery, NCII),
  3. creates a false impression of facts, in particular a false representation of statements, behaviour or actions of public or private persons in order to mislead the audience,
  4. depicts minors in any sexual manner or in a manner harmful to the welfare of a child,
  5. promotes illegal content, including hate speech, violence, terrorism, or discrimination on the basis of protected characteristics,
  6. infringes the intellectual property rights of third parties beyond the scope of permitted use,
  7. constitutes disinformation capable of materially disrupting the electoral process, public health or public safety.

5.3. Obligation to disclose deepfakes

Where a user creates AI-generated content that may constitute a deepfake within the meaning of Art. 3 point 60 of the AI Act, the Talent.pl website provides mechanisms for:

  • automatically labelling such content as a deepfake upon its publication,
  • displaying to the user information about the legal obligation to disclose the artificial nature of the content in accordance with Art. 50(4) of the AI Act.

Exceptions to the obligation to disclose deepfakes apply only in the cases referred to in the second and third subparagraphs of Art. 50(4) of the AI Act, i.e. where the content forms part of an evidently artistic, creative, satirical, fictional or analogous work or programme – in such cases, disclosure of the artificial nature of the content is required in an appropriate manner that does not hamper the display or enjoyment of the work.

5.4. Technical measures to prevent the creation of unlawful content

The Talent.pl website has implemented the following technical and organisational measures to prevent the creation of unlawful content:

  1. Prompt filtering – automatic analysis and filtering of input data (prompts) for indications of prohibited content categories, using keyword lists, classification models and other moderation mechanisms,
