Annex No. 1 – Talent.pl Terms for Creators

General provisions

  1. This document sets out the rules for the use of Talent.pl features by Creators who publish, generate, share or offer their Works through the Service.
  2. The Terms for Creators are an integral annex to the Talent.pl Terms of Service and should be interpreted together with the Terms of Service, the Price List, the Privacy Policy and the information presented in the User panel and in the purchasing process.
  3. In the event of any discrepancy between this document and an individual agreement concluded with a Creator, such agreement shall prevail to the extent that it expressly modifies the standard rules.

Additional definitions

  1. Creator – a User who independently publishes Works or uses the tools of the Service to generate Works and then shares them in the Service or outside it in accordance with the scope of rights granted to them.
  2. Work – any digital content made available by a Creator in the Service, including an image, graphic, design, visual material or AI Content.
  3. AI Content – content generated in whole or in part using artificial intelligence tools provided by Talent.pl.
  4. Plan – a paid model for using the real-time HD image generation service or a model without a subscription, in accordance with the current Talent.pl price list.
  5. Creator Payout – an amount due to a Creator for the sale of licences or other paid provision of Works, provided that the relevant feature has been activated in the Service for the given account.

Creator status

  1. A Creator may be a natural person, legal person or organisational unit with legal capacity that uses the Service in accordance with the Terms of Service.
  2. The Creator is obliged to provide true identification and billing data and to update it in the event of any change.
  3. The Service Provider may make the activation of publishing, monetisation or payout features conditional on account verification, including verification of the e-mail address, payment data, tax data or authority to represent.

Rules for publishing and generating Works

  1. The Creator may use one of the plans: Start, Creator or Agency, in accordance with the current Talent.pl price list.
  2. The Start Plan includes 100 HD images per month for PLN 38, the Creator Plan includes 250 HD images per month for PLN 98, and the Agency Plan includes 1,500 HD images per month for PLN 699.
  3. As a rule, unused monthly limits do not roll over to the next billing period, unless the plan description or an individual offer provides otherwise.
  4. The Creator is responsible for the content of prompts, reference files, descriptions, input materials and any other data used to generate Works.
  5. It is prohibited to generate or publish Works that are unlawful or infringe the rights of third parties, personal rights, trademarks, copyright or the principles of social coexistence.

Rights to Works and Creator’s liability

  1. The Creator represents that they hold the rights or a legal basis to use the input materials and to make the Works available to the extent resulting from the Terms of Service and this annex.
  2. The Creator bears full responsibility for the legality of the Works, including their compliance with copyright law, industrial property law, image rights, personal data protection and other rights of third parties.
  3. The mere generation of a Work using Talent.pl does not automatically mean exclusivity or a monopoly on a given style, motif, layout or visual result.
  4. If the Creator makes a Work available for licensing in the Service, they grant the Service Provider a non-exclusive authorisation to display thumbnails, descriptions and previews of the Work as part of the operation, promotion and sale of the Service’s services for the duration of the contractual relationship.

Models for making Works available

  1. The Creator may use the Service solely for the purpose of private or professional image generation for their own use or – if such a feature is active – for the purpose of offering Works to other Users on licensing terms.
  2. As a rule, Talent.pl operates on the model of a digital HD image generation service and the granting of licences to use the generated Works, not on the model of transferring the author’s economic rights.
  3. If the Service enables the Creator to sell or license Works to other Users, the detailed scope of the licence is set out in the Terms of Use of Works and the description of the specific offer.

Settlements with Creators

  1. If the Work monetisation feature is active for a given account, the Creator may be entitled to remuneration for the sale of licences to Works or other paid provision, in accordance with the billing panel, the offer or a separate agreement.
  2. Unless otherwise indicated in the Creator panel or a separate agreement, prices for the end User result from the current price list or offer published in the Service.
  3. The Service Provider may deduct from the Creator’s payouts commissions, payment operator fees, refunds, chargebacks, discounts, withholding taxes or other amounts provided for by law or the offer.
  4. Payouts may be conditional on reaching a minimum payout threshold, the correctness of billing data and the absence of an ongoing dispute, complaint or chargeback procedure.
  5. The Creator is responsible for the correct settlement of taxes and other public charges related to income earned through the Service, unless a separate agreement provides otherwise.

Prohibitions and restrictions

  1. The Creator may not publish Works that constitute an unlawful deepfake, impersonation of other persons, disinformation, fraudulent content or content that threatens public safety.
  2. The Creator may not use the Service to create datasets, train their own AI models on Content from the Service or download resources in bulk without the Service Provider’s consent.
  3. The Creator may not circumvent plan limits, share an account contrary to the Terms of Service or use automation that compromises the security or stability of the Service.

Moderation, reports and consequences of infringements

  1. The Service Provider may review Works, descriptions, thumbnails, metadata and the Creator’s activities for compliance with the Terms of Service, this annex and the law.
  2. In the event of a justified suspicion of an infringement, the Service Provider may refuse publication, remove a Work, restrict its visibility, withhold a settlement, suspend a payout or block the Account.
  3. The Creator has the right to submit explanations or an appeal in accordance with the Terms of Service.

Cancelling a plan and ending cooperation

  1. The Creator may cancel a paid plan in accordance with the terms indicated in the offer or the account panel, as a rule with effect from the end of the current billing period.
  2. Termination of the Account agreement does not release the parties from the obligation to settle previously concluded transactions, complaints, refunds, disputes or public charges.
  3. After the cooperation ends, the Service Provider may retain billing data and documents for the period required by law and for the time necessary to defend against claims.

Final provisions

  1. In matters not regulated by this document, the following shall apply: the Talent.pl Terms of Service, the Privacy Policy, the information on digital services and withdrawal, and generally applicable laws.
  2. This annex may be updated in accordance with the rules applicable to changes to the Terms of Service.
