Annex No. 2 – Talent.pl Terms of Use of Works
General provisions
- This document sets out the rules for the use of Works made available or generated in the Talent.pl Service, including Works generated using artificial intelligence tools (hereinafter “AI”).
- The Terms of Use of Works are an integral annex to the Talent.pl Terms of Service and apply to every User who downloads, saves, uses, publishes or commercially exploits Works available in the Service.
- The scope of rights to a given Work results jointly from the Terms of Service, this annex, the description of the offer, the selected plan, the purchasing process and the current price list.
Legal nature of the use of Works
- Unless expressly stated otherwise, Works are used on the basis of a licence and not on the basis of a transfer of the author’s economic rights.
- The standard Talent.pl offers, i.e. the Start, Creator and Agency plans, do not include a transfer of the author’s economic rights to the Works.
- The User obtains only those rights that have been expressly granted under the given model of use of the Work.
Obtaining access to Works
- The User may obtain access to Works in particular by purchasing a plan or using another offer indicated in the Service.
- Under the Start plan, the User receives up to 100 HD images per month for PLN 38, under the Creator plan up to 250 HD images per month for PLN 98, and under the Agency plan up to 1,500 HD images per month for PLN 699.
- Using the plan limit means the ability to generate a specific number of images in a given billing period, and unused limits expire at the end of that period, unless the offer provides otherwise.
Scope of permitted use
- The User may use a lawfully obtained Work for their own private and professional purposes, including saving it, storing it and using it in presentations, digital materials, online publications and marketing communication, provided that this does not violate restrictions arising from the law, the Terms of Service or the description of the offer.
- It is permitted to use a Work on social media, websites, in promotional materials, in a portfolio, in editorial materials and in branding activities, provided that the manner of use remains consistent with the nature of the licence granted and does not infringe the rights of third parties.
- If industry, quantity, channel, territorial or time restrictions are provided for a given Work or plan, these restrictions take precedence over the general rules set out in this annex.
Scope of prohibited use
- The User may not resell a Work as a standalone stock product, sublicense it or make it available in asset libraries, prompt repositories, template generators or other models that would allow third parties to make further independent use of the Work as the main value of the product.
- The User may not use Works to train AI models, build datasets, carry out mass scraping, recreate the Service’s library or engage in activities competing with Talent.pl without the express consent of the Service Provider.
- It is prohibited to use Works in a manner that infringes copyright, personal rights, image rights, personal data protection, the laws on combating unfair competition or the regulations on unlawful content.
- It is prohibited to use Works for fraudulent activities, disinformation, political manipulation, the creation of unlawful deepfakes or other uses that violate the law or the safety of third parties.
No exclusivity and similarity of results
- Unless the offer expressly provides for an exclusive licence, every licence granted through Talent.pl is non-exclusive.
- The User acknowledges that other Users may generate or obtain results similar in terms of style, composition, motif, colour scheme or overall visual effect.
- Purchasing a plan, a single generation or access to a Work does not mean being granted a monopoly on a particular style, aesthetic, theme or visual motif.
User’s liability
- The User assesses independently whether the manner of using a Work is consistent with their business needs, the law and the requirements of the given industry.
- If the User intends to use a Work in regulated sectors or high-risk applications, they should independently verify whether such use complies with the law and whether additional legal, technical and ethical checks are advisable.
- The User is responsible for combining a Work with their own materials, trademarks, advertising slogans, marketing claims or personal data of third parties.
Complaints and infringements
- If the User believes that the scope of the licence has been presented incorrectly or that a Work has not been made available in accordance with the description of the offer, they may submit a complaint in accordance with the Terms of Service.
- Using a Work beyond the scope of the licence may result in the obligation to cease the infringement and remedy its effects, blocking of the account, suspension of access to the Service’s features and the pursuit of claims provided for by law.
- The Service Provider may temporarily block access to a particular Work if there is a justified suspicion that its use or publication violates the law, the Terms of Service or the rights of third parties.
Consumers and digital services
- To the extent that access to a Work results from a digital service that is started immediately, the rules on the right of withdrawal and the loss of the right of withdrawal described in the Terms of Service and in the information on digital services and withdrawal apply.
- A lack of aesthetic satisfaction with a generated result does not in itself constitute a lack of conformity of the digital service with the contract, if the service was performed correctly from a technical point of view and in accordance with the description of the offer.
Final provisions
- In matters not regulated by this annex, the Talent.pl Terms of Service, the Privacy Policy and generally applicable laws shall apply.
- This annex may be updated in accordance with the rules provided for changes to the Terms of Service.
