3. What are cookies and similar technologies
- Cookies are small pieces of text information stored on the user’s end device, in particular a computer, smartphone or tablet, while using the Service.
- Cookies make it possible to recognise the user’s device and adjust the way the website works accordingly, maintain a session, remember settings, analyse traffic or carry out marketing activities, provided that the user gives consent where it is required.
- In addition to traditional cookies, the Service may also use other technologies that work in a similar way, such as “local storage, session storage”, tracking pixels, tags, device identifiers, analytics scripts or tools for measuring the effectiveness of communication and security, and their use is subject to the rules described in this Cookie Policy and the Privacy Policy.
4. Scope of use of cookies on Talent.pl
- The Service may use cookies and similar technologies in connection with the registration and maintenance of the user’s Account, logging in, using the features of the Service, generating AI content, processing payments, security, analytics, communication with the user and marketing of the Controller’s own services.
- Due to the nature of the Service, some cookies may also be used to maintain the user’s session, remember interface settings, secure the login process, prevent abuse and handle the purchasing or billing process.
- The Controller may also use cookie technologies for UX testing, the development of experimental features, measuring the use of AI features, assessing the quality of services and limiting technical or operational risk.
5. Types of cookies
5.1. Strictly necessary cookies
- Strictly necessary cookies are required for the proper functioning of the Service and its basic features, such as maintaining a session, logging in, security, handling forms, saving privacy preferences or correctly completing the purchasing process.
- The use of strictly necessary cookies does not require the user’s consent if they are genuinely necessary to provide an electronic service or to transmit a communication over a telecommunications network.
5.2. Functional cookies
- Functional cookies make it possible to remember selected user settings, such as language, interface preferences, account settings or other elements that make the Service more convenient to use.
- If a given type of functional cookie is not necessary for the service to work, its activation may depend on the user’s consent given via the cookie banner or the preference centre.
5.3. Analytics and statistics cookies
- Analytics and statistics cookies are used to study how the Service is used, measure traffic, analyse the popularity of individual features, detect errors, assess the effectiveness of the interface and develop the Controller’s services.
- The Talent.pl Privacy Policy provides for analytics, statistics, the development of the Service’s features, UX testing and measuring the effectiveness of communication and experimental features, and to the extent that non-essential cookies or similar technologies are used, consent given via the cookie banner is required.
5.4. Marketing cookies
- Marketing cookies may be used to promote the Controller’s own services, measure the effectiveness of campaigns, limit the number of times certain messages are displayed or tailor marketing communication to the user’s interests, provided that the legal requirements for consent have been met.
- Direct marketing of the Controller’s own services may be carried out on the basis of a legitimate interest or consent, depending on the type of communication channel and the specific technological solution, and where required by the laws on electronic communications or the provision of electronic services, the user’s prior consent is required.
5.5. Security cookies
- Some cookies and similar technologies may be used to detect abuse and to prevent spam, phishing, malware, scraping, crawling, attempts at unauthorised training of AI models, circumvention of security measures or other incidents affecting the security of the Service and its users.
- Such solutions may also be linked to system logs, device identifiers, account operation history and other technical data used to protect the infrastructure, detect incidents and defend against claims.
- Some of the above security and content moderation technologies also support compliance with the absolute prohibitions set out in Art. 5 of Regulation (EU) 2024/1689 (the Artificial Intelligence Act / AI Act), including the new prohibition on using AI systems to generate intimate or sexual content depicting a real person without their consent (non-consensual intimate imagery) and content depicting the sexual abuse of children, introduced by the Digital Omnibus on AI package and applicable from 2 December 2026 — in accordance with the rules described in more detail in the Terms of Service of the Service and in the Information on the Artificial Intelligence Act.
6. Legal bases for the use of cookies
- For strictly necessary cookies, the basis for their use is that they are necessary to provide electronic services, to ensure the transmission of a communication or for the proper operation of the Service.
- For analytics, functional or marketing cookies that are not strictly necessary, the basis for their use is, as a rule, the user’s consent given in the cookie banner, the preference centre or the browser settings, where such a model is legally permissible.
- Personal data processed using cookies may also be processed on the legal bases indicated in the Privacy Policy, in particular where this is necessary for the performance of a contract, compliance with legal obligations, ensuring the security of the Service or pursuing the legitimate interests of the Controller.
7. Cookie banner and consent management
- On their first visit to the Service, the user should receive a clear message about the use of cookies, together with the option to accept all cookies, reject non-essential cookies or go to the detailed settings.
- The cookie banner should allow consent to be given separately for individual categories, where required, in particular for analytics and marketing cookies.
- The user should be able to change their cookie settings at any time, in particular via the “Cookie settings” link available in the footer of the Service or in the account panel, if such a feature has been implemented.
- Withdrawal of consent does not affect the lawfulness of actions taken before it was withdrawn.
8. Data recipients and third-party tools
- Data collected using cookies may be transferred to providers of hosting, cloud infrastructure, CDN, analytics tools, marketing automation, CRM, newsletter services, monitoring and security, and to other entities supporting the operation of the Service, to the extent necessary to achieve the purposes of processing.
- The Controller may also use providers of tools used to generate AI content or to support the technical functions of the Service, if their operation involves the processing of technical or operational data.
- If a particular provider uses cookies or similar technologies on its own account, the user may also be subject to that provider’s privacy rules, of which the Controller should inform in the relevant clauses, lists of tools or implementation notices.
9. Transfer of data outside the EEA
- As a rule, the Controller aims to use providers that process data within the European Economic Area; however, due to the nature of internet services and technology tools, some providers may process data outside the EEA.
- If data is transferred outside the EEA, the Controller applies an appropriate mechanism to legitimise the transfer, in particular an adequacy decision, standard contractual clauses or another instrument provided for by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter “GDPR”.
10. Cookie retention period
- Cookies may be stored for the duration of the session, i.e. until the browser is closed, or for a longer period determined by their technical parameters or the settings of the provider of the given solution.
- The retention period of individual cookies may vary depending on their purpose, category, provider and the function they perform in the Service.
- Data related to security, logging in, operation history or the prevention of abuse may be stored for the period necessary to achieve these purposes, in accordance with the principle of data minimisation and the provisions of the Privacy Policy.
11. Managing cookies on the user’s side
- The user can manage cookie settings themselves via the settings of their web browser or device.
- In particular, the user may delete stored cookies, limit their storage, block selected categories of cookies or configure the browser to notify them each time a cookie is stored.
- However, restricting the use of cookies may affect the operation of some features of the Service, including logging in, maintaining a session, saving preferences, the purchasing process or features related to security and personalisation.
12. Link to personal data
- Some cookies or similar technologies may involve the processing of personal data, such as an IP address, device identifier, user identifier, activity history, session settings, approximate location derived from the IP address, and data about the browser or operating system.
- The rules for processing such data, including the purposes, legal bases, data recipients, retention periods and the rights of data subjects, are described in more detail in the Talent.pl Privacy Policy.
13. User rights
- To the extent that data collected using cookies constitutes personal data, the data subject has the rights set out in the GDPR, in particular the right of access to the data, rectification, erasure, restriction of processing, data portability, objection and withdrawal of consent, where processing is based on consent.
- The user also has the right to lodge a complaint with the President of the Personal Data Protection Office if they consider that the processing of their data in connection with cookies infringes the law.
14. Changes to the Cookie Policy
- The Cookie Policy may be updated in particular in the event of changes to the law, the practice of authorities, the scope of the Service’s features, business models, the analytics, marketing or security tools used, or changes resulting from the development of Talent.pl services.
- The current version of the Cookie Policy is published in the Service in a form that allows it to be saved, downloaded and reproduced.
- In the event of changes that significantly affect the rights or obligations of users, the Controller will take appropriate steps to inform them, in particular by means of a notice in the Service, an update of the cookie banner or an e-mail message, where appropriate.
15. Final provisions
- In matters not regulated by this Cookie Policy, the relevant provisions of the Terms of Service of the Talent.pl Service, the Privacy Policy and the applicable provisions of Polish law and European Union law shall apply.
- If any provision of this Cookie Policy proves to be invalid or ineffective, this does not affect the validity of the remaining provisions.
